Texas has a constitutional ban on most forms of commercial gambling (Article III, Section 47 of the Texas Constitution) and remains one of the largest untapped sports betting markets in the United States as of April 2026. There are no legal retail or mobile sportsbooks, no commercial casinos, and no legal online casino framework. What Texans can legally access: the Texas Lottery (Powerball, Mega Millions, Lotto Texas, scratchers — proceeds fund education and veterans programs); pari-mutuel horse and greyhound racing at licensed tracks like Sam Houston Race Park, Lone Star Park, and Retama Park, plus advance-deposit wagering through in-state platforms for those tracks; charitable bingo and raffles; and three Class II tribal gaming facilities on the Kickapoo (Lucky Eagle in Eagle Pass), Tigua (Speaking Rock in El Paso), and Alabama-Coushatta (Naskila in Livingston) reservations, which operate electronic bingo machines under federal IGRA authority despite ongoing state legal challenges. DFS contests from DraftKings, FanDuel, and PrizePicks operate in a gray area: a 2016 Attorney General opinion from Ken Paxton labeled paid-entry DFS illegal gambling, but no enforcement action has been taken and the major operators continue to accept Texas players.
For 2026, the status quo holds — no legal sportsbook, no commercial casino, no iGaming. Sands will continue its multi-year push for destination resort casinos, and pro sports teams (Cowboys, Astros, Rockets, Mavericks, Spurs) will continue lobbying for mobile sports betting, but the Senate blockade makes 2027 the earliest realistic launch year.
